Moment of contract conclusion:

According to the regulations in force, namely Government Ordinance no. 130/2000 on the legal regime of distance contracts, the moment of concluding the distance contract is the moment when INDIRA ART DISTRIBUTION SRL confirms acceptance of the order sent by you.

Object of the Contract:

The object of the contract is the products you have expressed your option to buy by placing an order, which was subsequently confirmed by INDIRA ART DISTRIBUTION SRL. The products have the characteristics mentioned on the www.indira.co.uk web page and are accompanied, as applicable, by warranty certificates.

Product price:

The price of the products purchased is the one mentioned on the www.indira.co.uk web page and includes VAT.

The discount corresponding to vouchers/coupons cannot be combined with other promotions or seasonal offers.

Price and method of sale

The products sold on the site are sold per piece, not by gram. The displayed price is the final price of the product, regardless of its weight.

Product weight

The weight indicated in the product description is for guidance and may vary slightly depending on size (especially in the case of rings) or the particularities of the manufacturing process. These variations do not affect the price of the product.

By placing the order, the customer confirms that they have taken note of this information.

Order payment:

Payment for the purchased products is made in cash, cash on delivery upon receipt of the parcel, by card payment, or by bank transfer.

Product delivery:

Delivery is made by courier to the delivery address indicated by you, through our partner Fan Courier.

The delivery time for the United Kingdom is 3-5 business days.

We ship Indira products, through our partner DHL, to all member countries of the European Union, with certain exceptions. Delivery is free for orders greater than 150 GBP. The international delivery period is between 4 and 7 business days. All Indira products shipped internationally are insured 100%. In the case of the United Kingdom of Great Britain, as a result of leaving the European Union, the customs duty for shipping gold and silver jewellery to the UK is 2.5% of the declared value of the goods.

Black Friday and other promotional campaigns

During these campaigns, the delivery time can vary between 24 hours and 7 days. The large number of orders may generate delivery delays. We apologise and assure you that we do everything possible to speed up the delivery process.

Also within these types of campaigns, coupons and value- or percentage-based vouchers from other previous campaigns or from newsletter subscriptions—namely the corresponding discounts—do not apply to the promotional price. Coupons and vouchers can be used and applied only to the full price of the product.

Products in Black or Flash promotions are original, sealed, and without hidden defects. Such campaigns also run with items with limited stock; therefore, there may be situations in which the ordered product has become unavailable in the meantime. The large number of orders is processed by the technical platforms based on the FIFO system.

If you would like more details about your order or about the next Black campaign, do not hesitate to contact us. Thank you for your understanding!

Information regarding product returns:

RIGHT OF WITHDRAWAL:

According to Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing certain normative acts, you have the right to withdraw from a distance contract, without giving a reason, within 30 calendar days, starting from the day on which “you or a third party other than the carrier, indicated by you, acquire physical possession of the products”.

Exceptions to the right of withdrawal include goods made to the specifications presented by the Buyer or clearly personalised, according to G.E.O. 34/2014: art. 16, letter c) “the supply of products made to the consumer’s specifications or clearly personalised.”

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract using an unequivocal statement by email: office@indira.ro.

You can also complete and submit electronically on our website www.indira.co.uk the standard withdrawal form or any other unequivocal statement. If you use this option, we will send you without delay, on a durable medium (for example, by email), confirmation of receipt of the withdrawal request (change the address in the form).

Or you can opt for the option accessible in your online customer account.

To comply with the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the 30 calendar days withdrawal period expires.

CONSEQUENCES OF WITHDRAWAL:

If you withdraw, we will reimburse the amount we have received from you, without undue delay and, in any case, no later than 30 days from the date on which we are informed of your decision to withdraw from this contract, but we may postpone the reimbursement until the date we receive the products back or until the moment you have provided proof that you have sent the products back, whichever is earlier. We will make this reimbursement by bank transfer; you will not be charged fees as a result of such reimbursement.

The costs of returning the products as a result of exercising the right of withdrawal will be borne by www.indira.co.uk. All exchanges and returns are subject to a flat shipping fee of 10 GBP.

You are responsible only for the decrease in value of the products resulting from handling other than what is necessary to determine the nature, qualities, and functioning of the products.

The product must be returned without damage, signs of wear, scratches, dents, missing accessories, together with the packaging in which it was delivered (delivery box, jewellery box) and its warranty.

ATTENTION! In situations where the box or the protective element in which the product is located contains identifying elements of the product (such as: product description, characteristics, product code/lot, instructions for use, age indications), these also perform additional functions and are not considered ”packaging” according to Law no. 249/2015. Therefore, THE PRODUCT CAN BE RETURNED ONLY TOGETHER WITH THESE BOXES OR PROTECTIVE ELEMENTS; otherwise, INDIRA ART DISTRIBUTION SRL will not accept the products. Lacking the possibility of being identified and without a description, the products become unsuitable for subsequent use and sale.

If the products are delivered to the consumer by INDIRA ART DISTRIBUTION SRL in transport packaging (bubble wrap for packaging, cardboard box that does not contain product identifying elements), in order to prevent damage to the product during handling and/or transport, it is not necessary for the products to be returned in these packages.

The following are excluded from the right of withdrawal, according to art. 16 of Emergency Ordinance no. 34/2014: “c) the supply of products made to the specifications presented by the consumer or clearly personalised; d) the supply of products which are liable to deteriorate or expire rapidly; e) the supply of sealed products that are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the consumer; f) the supply of products which, after delivery, according to their nature, are inseparably mixed with other items.”

RETURN OF NON-CONFORMING PRODUCTS:

Under Law no. 449/2003 on the sale of products and associated guarantees – republished, the seller is liable to the consumer for any lack of conformity existing at the time of delivery of the products.

In the case of lack of conformity, the consumer has the right to request the seller to bring the product into conformity, free of charge, by repair or replacement, or to benefit from a corresponding price reduction or termination of the contract. In the case of lack of conformity, the consumer has the right to request from the seller first the repair of the product, or the right to request the replacement of the product, in each case free of charge, except where the measure is impossible or disproportionate. The term “free of charge” refers to all costs necessary to bring the product into conformity, including postal, transport, handling, diagnosis, expert appraisal, disassembly, assembly, labour, materials used, and packaging.

It is not considered a lack of conformity if, at the time of the conclusion of the sales contract, the consumer knew or could not reasonably have been unaware of this lack of conformity, or if the lack of conformity originates in materials supplied by the consumer.

The seller’s liability is engaged if the lack of conformity appears within a period of 1 year, calculated from the delivery of the product. For products whose average service life is less than 1 year, this period is reduced to that duration.

Any replacement of products will be made within a reasonable period of time, agreed in writing by the seller and the consumer, and without any significant inconvenience to the consumer, taking into account the nature of the products and the purpose for which the products were requested. The set period may not exceed 15 calendar days from the date on which the consumer notified the seller of the lack of conformity of the product.

The lack of conformity of the products must be notified in writing to the seller within 2 months from the date of its discovery. After the expiration of the 1-year period, calculated from the date of delivery, consumers cannot claim the repair or replacement of products that cannot be used for the purpose for which they were made as a result of hidden defects that appeared within the average period of use, under the law.

Oxidation of silver jewellery is not considered a lack of conformity, as this is a natural process of silver and the oxidation layer can be removed. Also, the warranty does not cover the oxidation of jewellery.

WARRANTY FOR HIDDEN DEFECTS:

The seller guarantees the consumer against any hidden defects that make the sold good unfit for the use for which it is intended or that so diminish its use or value that, had they been known, the buyer would not have purchased it or would have paid a lower price. The warranty is owed if the defect or its cause exists at the date of delivery of the good. The seller does not owe a warranty against defects that the consumer knew at the conclusion of the contract. A defect is hidden if, at the date of delivery, it could not be discovered without specialist assistance by a prudent and diligent buyer.

INDIRA ART DISTRIBUTION SRL guarantees, in accordance with the provisions of Ordinance no. 21/1992 on consumer protection – republished, with subsequent amendments and completions, of Law no. 296/2004 on the Consumer Code and of Law no. 449/2003 on the sale of products and associated guarantees, that the products marketed comply with the quality standards in force of the European Community. The warranty is granted in accordance with the Romanian laws in force at the date of purchase and the warranty certificate accompanying the delivered product.

Complaints must be sent in writing to the Supplier’s headquarters in Bucharest, G Dem Teodorescu Street No. 11-13, 5th floor, ap. 39, sector 3, Tel.: 0726 963 030;, or by email to: support@indira.ro, and must be accompanied by the invoice/receipt, the warranty certificate, and a description of the observed issue (written complaint, signed and dated by the buyer).

The product will be returned by the client by courier to the Supplier’s headquarters mentioned above. The product can be returned only if it is in the original packaging. The cost of transport for the returned product will be borne by the client, unless otherwise specified; if the lack of conformity of the product is found, INDIRA ART DISTRIBUTION SRL will refund to the client the cost of transport, by postal order/bank transfer to the account indicated by the client. After analysing the complaint, if the lack of conformity of the product is found, INDIRA ART DISTRIBUTION SRL will proceed, as appropriate, to repair/replace the product, offer the client a corresponding price reduction, or terminate the contract, and will refund the price paid by bank transfer.

INDIRA ART DISTRIBUTION SRL will make no more than 2 attempts to complete the return.
