The rules of the "Giveaway" contest are organized by SC Indira Art Distribution SRL between 21.02.2023 - 1.03.2023 

These terms and conditions regulate the way in which you have the right to access and use the services associated with the "Giveaway" contest, hereinafter referred to as the "Contest". To use this contest, you must read and accept all the terms and conditions described in this document, including the personal data policy. 

ART. 1. THE CONTEST ORGANIZER 

The organizers of the "Giveaway" contest are SC Indira Art Distribution SRL, with 

headquarters in Str. Ghe Dem Teodorescu No. 11-13, Sc 1, Et 5, Ap 39, Sector 3, Bucharest, email address: 

office@indira.ro , hereinafter referred to as the Organizers. The contest will take place in compliance with the provisions contained in these regulations (hereinafter referred to as "the Regulations"). The terms and conditions of this Regulation, as presented below, are mandatory for all participants in the competition. The organizer reserves the right to modify these Regulations at any time. 

ART. 2. DURATION AND AREA OF CONTEST 

The competition will be organized and will take place between 21.02.2023 - 1.03.2023 on https://www.indira.ro/

ART. 3. THE RIGHT TO PARTICIPATE 

Any natural person domiciled in Romania who has reached the age of 18 at the start of the Contest has the right to participate in the Contest. All participants must have real, active and owned Instagram user accounts. Employees of Indira Art Distribution SRL and the partner companies that promote this contest, as well as their relatives up to the 2nd degree inclusive, cannot participate in the contest. Participation in this competition has the value of fully and freely consenting acceptance of the provisions of this Regulation. The right to participate belongs exclusively to the person who meets the conditions imposed by the Regulation. 

ART. 4. HOW THE COMPETITION IS CONDUCTED 

The contest takes place between 21.02.2023 - 1.03.2023, during which both those who have user accounts on the page https://www.indira.ro and those who are not currently registered can participate in the contest. 

The winners will be chosen on 1.03.2023 through the platform www.random.org 

ART. 5. DESIGNATION OF WINNERS
The winners will be selected from among those who followed all the steps of the contest: 

• I follow the Instagram page @theofficialindia
• posted at least one spring wish comment, tagging another person
• they shared the contest post in the story

The winners will be chosen on 1.03.2023 through the platform https://random.org/. They will be announced by tagging them on the story of the Instagram page. 

ART. 6. PRIZES 

The winner of the contest will receive 2 silver necklaces from the Birthflower collection. The prize will be delivered by SC Indira Art Distribution SRL to the winners following the transmission of personal and delivery data. 

Value of prizes:
1x birthflower gold pendant worth 450 RON

1x plain gold chain worth 670 RON

Total value of the prizes: 1120 RON 

The winners must send to the email address alexandra@indira.ro complete and correct delivery address, name, surname, telephone, email address and copy of the identity document for claiming the prize. 

Prizes cannot be exchanged for money or replaced with other products. 

ART. 7. PARTICIPATION MECHANISM 

The contest takes place between 21.02.2023 - 1.03.2023 , during which fans of the pages www.indira.ro and https://www.instagram.com/theofficialindira/ , but 

and those who do not currently follow the mentioned pages register for the contest as follows: 

• I follow the instagram page @theofficialindira
• posted at least one spring wish comment, tagging another person on the post with the contest
• they shared the contest post in the story

Careful!

• Any attempted fraud of any nature intended to damage the image of the organizer or third parties will be eliminated from the contest, and in case of identification of attempted fraud for the purpose of winning the prizes, the Organizer reserves the right to demand follow-up by the competent bodies and/or in the court of those persons, based on the existing evidence.
  
• People who will try to defraud the contest will have their access restricted. 
• The minimum age for participation is 18 years
  
• Prizes are delivered only on the territory of Romania 

ART. 8. AWARD OF AWARDS
There will be a single draw on March 1, 2023
The organizers will request the identification data of the winners and any other information deemed necessary for its validation.
Prizes will be delivered within 30 days of receiving complete data from the winners.
If the winners cannot be awarded for reasons independent of the organizers (they do not provide this information within 48 hours, etc.), the Organizers do not assume responsibility for non-compliance with these deadlines and will draw reserve winners who will be contacted after 24 hours will pass from the announcement of the first winners. The prizes will be accompanied by a handover-acceptance protocol that the winning person is obliged to sign and send to the Organizers at the e-mail address alexandra@indira.ro with the mention "Giveaway "
The organizers reserve the right to cancel any prize to any participant for any reason and at any time if they have suspicions about their activity on the organizer's website, Instagram, Tik Tok and within the contest. 

Prize winners cannot choose to receive the prize's value in money or other items, nor can they request other changes. The photos of the award are for presentation purposes. The organizers undertake to calculate and remit the tax due for the income in the form of prizes obtained by the winners, in accordance with the regulations of the Fiscal Code in force, any other obligations of a fiscal or other nature in connection with these incomes being the exclusive responsibility of the winners. 

Art. 9. DATA CONFIDENTIALITY
The organizers are registered in the General Register at the National Supervisory Authority for the Processing of Personal Data Personal Data Operator with no: 16919 and comply with the legislation in force in this field in Romania and the European Union.
By registering for the contest, you understand and agree that the Organizers will request from you, as a User, the following information necessary for your personal identification: (a) your name and surname, (b) valid e-mail address, (c) correct and complete delivery address, (d) phone number (e) Instagram id, (f) copy of identity document. The purpose of requesting this information by the Organizers is to maintain contact with you for future communications about offers and other contests accessible from the website www.indira.ro. 

After collecting your data, the Organizers: will not alienate, rent or sell your personal identification information to third parties for marketing and advertising purposes. They will not provide your contact data to third parties without your consent, except in cases where they are requested by legally authorized state institutions (with a control role, etc.) they will secure the essential information you provide, through standard protocols and technologies corresponding to.

  

Art. 10. TERMINATION OF SERVICE 

You agree that the Organizers may, at any time, without prior notice, interrupt your account and access to the online contest, for reasons that may be, but not limited to: (a) your violation of the provisions of this document and the guidelines it includes, 

(b) requests from governmental institutions and impositions of the law, (c)
your express request,
(d) unforeseen technical issues and aspects,
(e) long periods of inactivity of the page you created within the contest. 

You agree that the interruption of the provision of the service will be made at the free choice of the Organizers and that they cannot be held responsible to you or any other third party for the interruption of your access or your page in the online contest. 

Art. 11. INFORMATION PROVIDED 

You understand and agree that by posting materials on the page https://www.instagram.com/theofficialindira , you give the Contest Organizers the free and irrevocable right to use these materials during the existence of the service, but also after its development. 

You understand that the responsibility for all the information you post in the online contest will fall exclusively to you, and the Organizers cannot be held responsible for any mistake or omission in this information. The Organizers cannot guarantee the identity of any of the users who create or access the individual pages on the page https://www.instagram.com/theofficialindira and the Organizers cannot guarantee the authenticity of any information posted by users. 

You agree not to monitor or copy, and not to allow others to monitor or copy the page https://www.instagram.com/theofficialindira and www.indira.ro and the content it contains. You agree not to simulate the appearance or operation of this website and not to act to disrupt the operation or overload our IT infrastructure, including, but not limited to, unsolicited communications, attempts to gain unauthorized access, transmission or activation of viruses informatics. 

ART. 12 COMMUNICATION WITH THE ORGANIZER 

During the contest on the https://www.indira.ro page, the organizers may need to communicate with you by email or phone (see the Data Confidentiality and Contest Prizes and winner designation chapter). You agree to receive email messages related to your participation in the contest to ensure the smooth running of the contest. 

You agree that your name and/or email address will be mentioned in the title of certain communications that you initiate on the Instagram page https://www.instagram.com/theofficialindira and by email (example: winner announcement). You understand and agree that the Organizations can use your contact data for the purpose of consulting or informing you about products, offers and promotions. You can give up 

This is a privilege through the unsubscribe service from the email messages received from the www.indira.ro website. The organizers exercise their right to modify any of the articles of this document in order to ensure the coherence and correctness of the contest. The organizers will post any changes to this document on the Instagram page https://www.instagram.com/theofficialindira, but also by email 

ART. 13. TAXES AND COSTS 

Registration in the contest is free. The prize is subject to taxes and fees according to the law and will be borne by the Organizers. 

ART. 14. LIABILITY LIMITS 

By accepting this regulation, you agree that the Organizers, their employees, partners and
any other collaborators in the online contest are not responsible for any direct, indirect, occasional or exceptional losses or negative consequences resulting from: 

1. using the page https://www.indira.ro 
2. unauthorized access or alteration of your communication with or through Instagram and Tik Tok

ART. 15. APPLICABLE LAW 

This regulation represents an agreement between you and the Contest Organizers, governed by Romanian legislation in force. 

In accordance with the provisions of the GDPR, we inform you of the following: 

We do not use personal data for automated processing or to create profiles. We never make automated decisions about you. 

We use technical means to store data under security conditions. We do not process data for secondary purposes incompatible with the purposes for which we collected it. 

We review the collected data every year, analyzing to what extent their retention is necessary for the stated purposes, your legitimate interests or the fulfillment of legal obligations. Data that is no longer needed will be deleted. 

You benefit from the right of access, intervention, rectification and portability regarding the data you provide us, and you can limit the processing carried out by us and even request the deletion of the data. 

This section represents information regarding the legal provisions regarding the processing of personal data that you will transmit to us and that appear or will appear in the fiscal documents that highlight our communication relationship. 

By participating in the competition, the participants agree to the processing of data under the conditions mentioned above.
