Black Friday Contest Regulations

1. Art. 1 The Contest Organizer

   1.1. The company Indira Art Distribution SRL, headquartered at Str. Ghe Dem Teodorescu No. 11-13, Sc 1, Et 5, Ap 39, Sector 3, Bucharest, organizes the Black Friday contest starting from October 31st until November 3rd.

   1.2. These regulations represent the set of conditions and rules established by SC INDIRA ART DISTRIBUTION SRL, the organizer of the Black Friday contest, regarding its organization and conduct.

   1.3. Indira holds all rights and obligations arising from its capacity as organizer of the contest. The organizer has the right to change the concept and format of the contest whenever it deems it necessary, but notifying the public in advance, using any means.

   1.4. The present concept and format of the contest are the object of the organizer's copyright, being protected according to the provisions of Law no. 8/1996 on copyright and related rights.

   1.5. The competition regulations will be available on the website www.indira.ro

   Article 2. Organization of the competition. Competition mechanism.

   2.1. The contest entitled "Black Friday" takes place from October 31st until November 3rd on the Organizer's Instagram page (https://www.instagram.com/theofficialindira )

   2.2 On October 31, 2024, the organizer will post the contest announcement image on its Instagram page.

   Participation in the above-mentioned contest requires each contestant to create an account, add the desired jewelry to the wishlist and subscribe to the newsletter. The contest will end on November 3, 2024, at 11:59 pm, and the winner, chosen by the Indira team, will be announced in the following days by drawing lots. The winner will receive the prize provided by the organizer.

   Article 3. Contest participants

   3.1 Any natural person who provides proof of domicile or residence in Romania, who has reached the age of 14 prior to the date of registration for the contest, may participate in the contest entitled "Black Friday".

   3.2 By registering for the "Black Friday" Contest, each participant unconditionally accepts and agrees with all contest rules.

   3.3. Employees and contract collaborators of the organizer, relatives of the organizer's employees up to the 2nd degree, as well as employees and their relatives up to the 2nd degree belonging to third-party companies or foundations involved in promoting the project represented by the contest entitled "Black Friday" cannot participate in the contest.

   Article 4. Value and awarding of contest prizes

   4.1 The prize for the “Black Friday” contest, organized by Indira, consists of silver jewelry worth 1500 lei. The price of the silver jewelry will be considered the full price and not the reduced price.

   4.2 The total value of the prizes awarded is approximately 1500 lei.

   4.3 The winner of the competition will be verified for a valid email address and for compliance with the rules of the Competition. The potential winner must respond to the Competition Organizer's message no later than 72 hours from the date of posting the winner's announcement. In the event that the potential winner does not respond to the Indira notification within the specified time, or the email is not valid, a new winner will be chosen by random drawing. The alternative winner will be contacted via private message and must respond to the Competition Organizer's notification no later than 72 hours from the date of posting the prize announcement.

   4.4 The winner of the contest will receive silver jewelry at full price (without the applied discount) worth 1500 lei.

   4.5 The delivery period for prizes may take up to 4 weeks. The Contest Organizer reserves the right to substitute a prize of equal value at its sole discretion, unless prohibited by law. The Contest Organizer may disqualify a winner and select another winner at random if the prize has not been claimed. The prizes are non-transferable and their financial value cannot be claimed. The Contest Organizer is not obliged to replace the prize at the winner’s request if the size does not fit or the product does not meet expectations.

   Article 5. Taxes and duties

   5.1 The prizes awarded within this contest entitled "Black Friday" are subject to taxes and duties under the conditions established by the Romanian Fiscal Code or under the conditions established in the Conventions for the avoidance of double taxation signed between Romania and third countries, in the case of winners who are beneficiaries of dual citizenship, one of which is Romanian citizenship.

   5.2 The organizer of the contest entitled "Black Friday" is obliged to withhold at source and transfer to the state budget the taxes established according to the Romanian Fiscal Code and the Conventions for the avoidance of double taxation mentioned in art.5.1.

   5.3 The contest organizer will bear the taxes and fees established according to the Fiscal Code for the prizes awarded.

   5.4 By registering for this competition, the Participant (i) waives any rights in and to any material submitted by the participant in connection with this competition (including all moral and copyright rights); (ii) acknowledges and agrees that the recordings (including the material submitted by the participant in connection with the competition) become the property of the Organizer and will not be returned; and (iii) grants the Organizer the absolute right to edit, modify, publish, exploit and use the recording, voice, actions, likes, name, biographical material, written works, as well as all other information or materials that the participant makes available or may be made available through the competition in any media, now known or invented hereafter, and in any manner, without further approval.

   5.5 The Organizer reserves the right to verify the accuracy or truthfulness of any information contained in any entry in the Contest. The Organizer has the right, in its sole discretion, to determine whether any entry is not suitable for publication on the Site or for any other public release and whether it complies with the Contest Rules. The Organizer reserves the right to disqualify any entry in the Contest, if it considers that there are reasonable grounds or suspicions in this regard. The Organizer's decisions are final and binding on all matters related to this Contest.

   Art. 6. Limitation of the Organizer's liability:

   6.1 The Contest Organizer and its respective affiliates, subsidiaries, parent corporations, advertising and promotion agencies, as well as all employees, shareholders, are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruptions, deletions, or defects of the telephone network, online computer system, computer equipment, servers, providers, or software, including any damage or damage to the computer of the entrant or any person in connection with the inability to participate in this Contest; inability to access the site or upload information or data; theft, manipulation, destruction or unauthorized access to the Contest entry data that is processed late or incorrectly or incomplete, or loss of telephone, computer or electronic failure or for any other reason; printing errors; or any combination thereof. Proof of uploading data or information and its entry on the site is not considered proof of delivery or receipt. Illegal, duplicate, and incomplete entries will be disqualified. Fraudulent, deceptive, or false entries or acts will render participants ineligible and all related entries or votes will be considered void.

   6.2. As a condition of participation in the Contest, participants release the Organizer and its subsidiaries from liability for any loss, damage, injury, cost or expense, including any damage to property, personal injury and death that may arise in connection with participation in the Contest, or possession, acceptance or use of the prize or participation in any activities related to the promotion and claims based on publicity rights, copyright or copyright infringement, defamation or invasion of privacy and delivery of goods.

   Art. 7 Special provisions:

   7.1 Potential winners are subject to verification by the Organizer. The Organizer's decisions are final and binding in all aspects of the contest. Potential winners must comply with the Contest Rules, and receipt of prizes is conditional on compliance with all of their requirements. The Organizer is not responsible for technical, hardware or software failures, unavailable connections or incomplete computer transmissions, or unforeseen related changes, which may limit the ability of competitors to participate in the Contest, even due to the Organizer's negligence. The Organizer has the discretion to modify, cancel or suspend this contest due to viruses, unauthorized human intervention or other causes beyond the Organizer's control, intended to affect the proper administration of the Contest, established from the outset. The Organizer is not responsible for changes made to the contact information of participants. No false or altered entries from reality will be accepted. The Organizer decides at its own discretion to disqualify any participant who does not comply with the Contest Rules or attempts to manipulate the operation of the Contest or engages in conduct that is detrimental to the Organizer, the Contest or any other participant.

   7.2. The organizer does not assume responsibility, which belongs entirely and exclusively to the participants, for:

   7.2.1. Illegal appropriation by participants of uploaded photos and failure to respect copyright;

   7.2.2. Situations in which participants provide incorrect or incomplete identification data, which may lead to the Organizer's inability to contact the respective participant and therefore to deliver the prize;

   7.3. Any complaints related to the conduct of the Competition will be made to the Organizer's email address support@indira.ro by November 20, 2020. Subsequent complaints will not be taken into account.

   7.4 In accordance with the requirements of Law No. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, the Organizer processes the personal data of the Participants as a personal data controller.

   7.5 By participating in the Contest, Participants expressly and unequivocally agree that their personal data will be entered into the Organizer's database for the purpose of validation, awarding prizes, fulfilling the Organizer's tax obligations, as well as for the purpose of sending advertising and direct marketing communications to Participants. By participating in the Contest, you express your agreement that the Organizer may use the data provided by you to promote the Organizer's products and services, as well as those of partner companies, such as, but not limited to:

   - sending advertising and marketing messages, as well as for sending offers regarding services and products;

   -transmission by telephone or SMS, post or other electronic means of communication (eg e-mail) of information regarding services and products;

   -participation in various contests and other promotional marketing and advertising actions regarding certain services and products;

   -improving products and services to meet your needs by providing news, case studies and conducting opinion polls.

   This Contest is not sponsored, endorsed, administered by, or associated with Facebook or Instagram.

   Art 8. Applicable law

   8.1. These Regulations represent an agreement between the participant and the Contest Organizer, governed by Romanian legislation in force.
